APHIS Overall Enforcement Summary

In Fiscal Year (FY) 2015, IES opened 1,922 cases; issued 801 official warnings; and entered into 431 voluntary settlement agreements (or pre-litigation stipulation agreements) that resulted in the assessment of $619,117 in stipulated penalties. Through USDA’s Office of the General Counsel (OGC), IES also obtained administrative orders assessing $78,550 in civil penalties. On average, IES completed cases in 346 days. (IES considers a case complete once it issues an official warning, issues a voluntary settlement and the recipient agrees to the settlement, finds there is not sufficient evidence to support enforcement action, or refers a case to OGC.)

In FY 2015, IES achieved long-term performance measures it had established for itself in 2011, reducing (1) its inventory of open investigations by 72% (from roughly 2,100 to 587 open investigations); and (2) the time to complete an investigation and resulting enforcement action by 45% (from 632 days to 346 days).
